Please be advised that the Wellness Fund Integrated Health Services benefit (basic medical insurance) will only cover employees whose monthly contributions towards the Wellness Fund (together with the contribution from employers) are at least R160.17 effective from 01 March 2024.

SATAWU Levies and Membership Subscriptions- Double Deductions - NBCRFI

The South African Transport and Allied Workers Union (SATAWU) writes this letter in conjunction with the 4th National Congress (NC) and September 2022 CEC (Central Executive Committee) resolutions. The NC resolved that “the union should consider adding a once-off 1% and/or R1.00 to the current subscriptions” however, the September 2022 CEC synthesised the latter decision by deciding that “there should be a double deduction on subscriptions for a period of 2 to 3 months” furthermore, the “… NOBs [National Office Bearers] had to use their discretion and/or employ various methods when dealing with the question of double deductions”.

Circular to the Industry on Online Exemption

We are pleased to announce the official launch of the new online exemption system. Employers can submit exemption applications through the online platform. Employers must first register on the system in order to upload the manual exemption application form and supporting documents or complete the form online and upload all supporting documents. Circular on Online Submission of Leave Pay and Sick Leave Benefit

I refer to the above matter. Please be advised that Council will no longer accept manual applications in respect of annual/occasional leave pay (Annexure A.6) and sick leave applications (Annexure A.8) so as to proactively mitigate fraud related risk. To ensure a smooth transition for all employers, Council will allow a 6-month transition period for employers to still submit manual applications.

Please be advised that the Minister of Employment and Labour has approved the amendment to clause 67A (3) and (4) of the Main Collective Agreement that deals with the Dual Driver System. The amendment was published on 25 November 2022, in Government Gazette No 47559. The amendment is in effect from the second Monday, 5 December 2022, after the date of publication of the Notice until the 29th of February 2024.

IMPLICATIONS OF THE CABINET ANNOUNCEMENT ON THE ZIMBABWE EXEMPTION PERMIT (ZEP)

The Cabinet in its meeting of Wednesday 24 November 2021 announced that the Zimbabwean Exemption Permit (ZEP), which ends on 31 December 2021, will not be extended. We refer to the industry circular dated 21 October 2020. The President put the country on an adjusted Level 3 of the national lockdown following the surge of the second wave of COVID 19 cases in the Country. In this regard, the NBCRFLI has resolved to reinstate the sick leave fund temporary relief measures because there is an increased number of employees that are in isolation and do not have medical certificate or only a positive laboratory results for COVID 19.

The High Court of South Africa (Gauteng Division, Pretoria) has granted the National Bargaining Council for the Road Freight and Logistics Industry (Council) an interdict against ATDF and the SANCTDA from organising, encouraging, inciting any other person to, and/or participating in protest action or “national shutdown” against the employment of foreign nationals in the Road Freight and Logistics Industry on 7 July 2020 or at any time thereafter.

The National Bargaining Council for the Road Freight and Logistics Industry (Council) has become aware of media report from eNCA that the South African Health Products Regulatory Authority (SAHPRA) is investigating allegations that Affinity Health (Pty) Ltd (Affinity Health) was involved in the unlawful importation of chloroquine, that Affinity was dispensing the medication to its staff as a COVID-19 preventative measure, and that the company planned to distribute chloroquine to its network of pharmacies

The NBCRFLI together with its Health Plan service provider, Affinity Health, are pleased to announce the refinement of the Health Plan in terms of the benefits provided. The two companies have been working closely together to identify members’ specific needs, thereby making the plan more focused on precisely what our members require. As a result, the Health Plan is now tailor-made, based on the benefits recognized as vitally important. These amended benefits come into effect on 1 March 2019.

Sick and Absence Fund: Medical Certificates

Clause 19 (9) of Council’s Main Collective Agreement provides that a medical certificate, for the purposes of occasional sick leave, must be issued and signed by a medical practitioner or any person who is certified to diagnose and treat patients and who is registered with a professional council established by an Act of Parliament.

Wellness Fund Minimum Contributions

Please be advised that Council has resolved that the Wellness Fund Health Plan (basic medical insurance) will only cover employees whose monthly contributions towards the Wellness Fund (together with the employers portion) is at least R 69.12 effective 01 October 2013.

Council Monthly Returns

From now on, all monthly returns in terms of the sick, leave, holiday bonus, levies, trade union subscriptions and the wellness fund must be completed on the NBCRFLI E-Business online system on or before the 20th of the month.
Exemption of VAT on levies

Kindly note that monthly levy contributions to Bargaining Council have now been classified as exempt supplies for VAT purposes. This follows the recent insertion of section 12 (l) to the VAT Act, No. 89 of 1991 (as amended).

Sick leave bonuses become payable on completion of the three year cycle after commencing employment or from the date that the previous sick leave cycle expires. In order to provide for sick leave bonuses to be paid out separately from annual leave, Annexure A.6: Payment Voucher was slightly amended.
Provident Fund Banking Details

It has come to our attention that some employers have failed to use the correct bank account when making payment to the Road Freight and Logistics Industry Provident Fund. It is imperative that the correct account and referencing be used in order to ensure timeous allocation for the resultant cover for insured benefits to apply.
Sick and absence fund leave bonus payments

It is imperative to take note of the revised payment of sick leave bonuses, as the sick leave clause in the Main Collective Agreement had to be aligned with the provisions of the Basic Conditions of Employment Act, 75 of 1997.

NBCRFLI Negotiations Update

The Parties to the NBCRFLI embarked on wage negotiations in June this year. Whereas the parties were able to reach agreement on many issues, the across the board (ATB) increment, remains in dispute. As a consequence, the strike called by the trade unions will continue and at this stage no further discussions between parties are planned.

Wage Agreement in the Road Freight and Logistics Industry

The Parties to the NBCRFLI wish to inform the Industry that the Memorandum of Agreement purportedly entered into “in the CIT Chamber” dated 28 September 2012 is null and void and of no force and effect.
The signed wage agreement between the parties to the Council dated 12 October 2012 is hereby adopted as the formal wage agreement.

As from December 2012, the 13th cheque (holiday pay bonus) must be paid directly to the employees. Without the correct details, it will not be possible for Council to pay-out these 13th cheques.

The purpose of this Circular is to clarify the application of Clause 19 in the Main Collective Agreement regarding the provision of the Sick and Absence Fund.
Medical Certificates

According to the Main Collective Agreement, the Council is not required to pay an employee occasional sick leave if the employee fails to produce a medical certificate. The medical certificate must be issued and signed by a medical practitioner or any person who is certified to diagnose and treat patients and is registered with a professional Council established by an Act of Parliament.

Industry Provident Fund Shared Services

The NBCRFLI recently acquired an approval from the Financial Services Board (FSB) to administer the industry provident fund. The section 13B approval allows the Council to play a more active role in provident fund management for the industry by allowing it more control over the collection and enforcement process.
Amendments to the main collective agreement

On the 21st of February 2011, the employer (Road Freight Employer’s Association) and union parties (South African Transport and Allied Workers Union, Transport and Allied Workers Union, Motor Transport Workers Union and Professional Transport and Allied Workers Union of South Africa) to the Road Freight and Logistics Bargaining Council concluded an agreement on the wages and conditions of service.
Declaration of Public Holiday on 18 May 2011 (Local Government Elections)

Wednesday 18 May 2011 has been declared a public holiday and has been gazetted under Proclamation No. 27, 2011 in Government Gazette 34127 dated 16 March 2011.
We hereby notify the industry that the 18 May 2011 will therefore be a paid holiday as per Clause 10 of the NBCRFLI’s Main Collective Agreement.
New Bank Account Details

The NBCRFLI (Council) has opened accounts with the four major banking institutions in South Africa in order to overcome the challenge of delayed transfers across banks as well as to ensure that all income received is easily allocated. Implementation of a New Information Technology System

Wage increases: Furniture Removal Sector

Change of Bank Deposit / EFT Reference

Employers are informed that from 03 August 2009 the reference used when making deposits/electronic fund transfers (EFT) into Council’s bank account will change. Council makes use of the reference number to correctly allocate payments that have been made by members of the industry. Without the correct referencing monies received remain unallocated.
Delayed Monthly Returns

Clause 54 of the Main Collective Agreement stipulates that monthly returns (along with the related proof of payment) are to be submitted to Council by the 20th day of each month – that is, in respect of the previous month. This allows for the returns to be processed in a timely and efficient manner within Council.
Council no longer accepting cheques

Following a notification issued by NBCRFI earlier this month, employers are reminded that Council offices will no longer be accepting cheques (via post or hand delivery) effective 01 April 2009.
Payment of returns by cheques and cash

Employers are informed that from 01 April 2009 we will not be accepting cheques as a method of payment via the post or at any of our NBCRFI offices. This is in an attempt to reduce the risk of fraud generally associated with cheques. Moving forward, Council is gradually phasing out the manual processing of returns and employers are encouraged to convert to electronic returns submissions as soon as possible.
PAYE Treatment of NBCRFI Contributions

Members of the road freight industry are hereby reminded that the onus lies with respective employers to make PAYE deductions in terms of the applicable tax legislation. This applies to all contributions paid to the Council and its respective funds as such funds contributions constitute remuneration as defined in terms of paragraph 2 of the Fourth Schedule of the Income Tax Act, 1962.
Extension of Agency Shop Collective Agreement

On 22 December 2008 the Minister of Labour promulgated the Agency Shop Collective Agreement for the road freight industry. This agreement requires road freight industry employers and employees who benefit from collective bargaining contribute towards the cost thereof.
Mobile units to provide support in cholera affected province

Due to the cholera outbreak that has affected Limpopo Province, the National Bargaining Council for the Road Freight Industry (NBCRFI) is providing support to the drivers by sending two of our mobile units to the area.
These units are ordinarily used as part of our Trucking Wellness programme, providing primary healthcare and voluntary testing and counselling.

Provident Fund Update

Road Freight Industry Wellness Fund

Members of the road freight industry are by now familiar with the Wellness Fund clause that was added to the Main Collective Agreement in 2007. Since then an additional levy has been collected, as stipulated in the Agreement, the contributions of which are to establish a fund that support the rollout of anti-retroviral treatment for HIV/Aids sufferers within our industry.
