The Enforcement Department of NBCRFLI is responsible for ensuring that all parties within the road freight and logistics industry comply with the provisions of the Collective Agreements and relevant labour laws. We are committed to creating a fair and equitable working environment.

ENFORCEMENT

Role of the Designated Agent

The Council aims to ensure that the provisions of the Council's Agreements are complied with by all stakeholders in the road freight and logistics industry. The designated agents play a vital role in the achievement of this goal.

Designated agents are appointed by the Minister of Labour at the request of a bargaining council to promote, monitor and enforce compliance with any Collective Agreement concluded in that bargaining council.

Powers of Designated Agents

Due to the role that designated agents play, they are granted certain powers to effectively monitor and enforce compliance with Collective Agreements:

Enter any workplace without warrant or notice (except homes)

Require disclosure of information, orally or in writing, under oath if necessary

Inspect and question persons about records or documents

Copy, remove or require delivery of relevant records and documents

Inspect, question about, and remove articles, substances or machinery

Question persons about work performed

Be accompanied by interpreters and assistants during inspections

Working Together

One of the main challenges faced by designated agents is to educate stakeholders on the correct interpretation and application of the provisions of the Council's Agreements. The Council therefore urges members to become familiar with the Collective Agreements, to abide by them and to work together with the agents to ensure the implementation thereof.
