This privacy notice ("Notice") informs you on how your personal information ("PI") is collected and used by the National Bargaining Council for the Road Freight and Logistics Industry (Council) when engaging with us and based on the requirements of Protection of Personal Information Act 4 of 2013. This includes what PI we collect from data subjects, how we use it, and for what purpose.
This Notice applies to all PI gathered from, amongst others, the Council's industry employers, employees, independent contractors, service providers, Industry Employer organisation, as well as Trade Unions.
The Council collect and process certain PI about you when you engage with the Council to enable us to manage our relationship with you, and to appropriately conduct Council's business mandate. This PI will be collected directly from data subjects and where necessary, other sources, including external sources may be used subject to all applicable laws.
1. What Personal Information the Council Collects
Personal Information("PI") means any information that can be used to identify directly or indirectly a specific individual (Data Subject). This definition includes personal information collected through applications accessed or used through third-party platforms.
When you engage with the Council, whether as an existing Council's employee or prospective employee, industry employer and employee, independent contractor, service provider, Industry Employer organisation and Trade Union or otherwise, the Council may collect PI about you. This PI includes, amongst others, information relating to your name, financial or employment history, contact details, any references, and other private or confidential information about you.
2. How the Council Collects Your Personal Information
The Council collects the Personal Information directly from Data Subjects in the ordinary course of its business under various circumstances such as: (i) where industry employees open cases with Council; (ii) where industry employees and employers register with the Council; (iii) where industry employers apply for exemptions; and (iv) where industry employees and employers apply for employee benefits, sick leave, annual leave and leave funds pay-outs.
3. Retention of your personal information
We keep and retain your PI only for the purposes of which the personal information is processed for/or as required by specific law or regulation. The length of time we retain personal information will depend on the purposes for which we collect and use it for and/or as required to comply with applicable laws and to establish, exercise or defend our legal rights.
4. How we keep your personal information secured
The Council is committed to protecting your PI from any loss, misuse, disclosure, alteration, unauthorised access, unavailability, destruction, and takes all reasonable precautions to safeguard the confidentiality of personal data, including through use of appropriate organisational and technical IT measures.
5. What are your rights?
You have a right to request access to your PI at any stage. Should you believe that any of your personal information held by the Council is incorrect or incomplete, you have the right to request to update this information, rectify it or have it deleted.
